These Terms of Service (“Terms”) govern your access to and use of the IMD Skincare website at imdskincare.com, including any purchases, accounts, and features offered (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement and that you have the legal authority to agree to these Terms.
2) Account & Security
You may need an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at info@inkedmd.com if you suspect unauthorized access or use.
3) Orders, Acceptance & Availability
All orders are offers to purchase subject to our acceptance. We may accept, decline, or cancel an order at our discretion (for example, if a product is unavailable, there is an error in pricing or product information, or we suspect fraud or abuse). If we cancel after you have been charged, we will issue a refund to your original payment method.
4) Pricing, Taxes & Payment
Prices are shown in U.S. dollars and are subject to change without notice. Applicable taxes will be calculated and collected at checkout where required by law. We use third-party payment processors and do not store full credit card numbers. By submitting payment information, you authorize the applicable charges.
5) Shipping, Risk of Loss & Title
We offer free standard shipping within the United States; see our Shipping Policy for processing times and delivery estimates. Title and risk of loss pass to you upon delivery to the address specified in your order based on the carrier’s delivery confirmation. We are not responsible for carrier delays or events beyond our control.
6) Returns, Refunds & Exchanges
Due to the personal and hygienic nature of skincare products, we cannot accept returns of opened or used items. Unopened items may be eligible for a return within 30 days of delivery, subject to our Return & Refund Policy. If you receive a damaged, defective, or incorrect product, contact info@inkedmd.com within 7 days of delivery.
7) Product Information & Medical Disclaimer
We strive for accuracy, but product descriptions, images, and ingredients may contain minor inaccuracies or typographical errors. IMD Skincare products are for external use only and are not intended to diagnose, treat, cure, or prevent any disease. Content on the Services is provided for informational purposes only and does not constitute medical advice. Consult a qualified healthcare professional for medical questions.
8) Promotions, Gift Cards & Subscriptions
Promotions are subject to additional terms and may change or end at any time. Gift cards are not reloadable, redeemable for cash (except as required by law), or replaceable if lost or stolen. If we offer subscription or auto-delivery programs, the terms disclosed at signup will apply, including recurring billing until you cancel per those terms.
9) User Content & Reviews
If you submit reviews, photos, or other content (“User Content”), you grant IMD Skincare a worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, display, and otherwise exploit such User Content in any media. You represent and warrant that you own or have rights to the User Content and that it does not infringe, misappropriate, or violate any rights of others or any law.
10) Intellectual Property
The Services, including all text, images, graphics, logos, product names, and other content, are owned by IMD Skincare or its licensors and are protected by intellectual property laws. No rights are granted except as expressly set forth in these Terms. You may not copy, distribute, modify, or create derivative works from the Services without our prior written permission.
11) Prohibited Uses
· Violating any applicable law or regulation;
· Infringing, misappropriating, or violating intellectual property or privacy rights;
· Submitting false, misleading, or fraudulent information;
· Interfering with or disrupting the Services or servers;
· Using bots, scrapers, or other automated means without permission;
· Transmitting malware or other harmful code;
· Engaging in harassment, abuse, or conduct that harms or threatens others.
12) Third‑Party Services & Links
The Services may include links to or integrate with third‑party websites, tools, or services (e.g., payment processors, analytics). We are not responsible for third‑party content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms and privacy policies.
13) SMS Terms (TCPA Consent)
By providing your mobile number and opting in, you consent to receive marketing messages from IMD Skincare. Message frequency varies. Message and data rates may apply. 14) Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMD SKINCARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES OR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO IMD SKINCARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
16) Indemnification
You agree to indemnify, defend, and hold harmless IMD Skincare and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or Products, your breach of these Terms, or your violation of any law or third‑party right.
17) Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles, and applicable federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
18) Dispute Resolution; Arbitration; Class‑Action Waiver
Please read this section carefully. It affects your rights.
Most customer concerns can be resolved quickly by emailing info@inkedmd.com. If we cannot resolve a dispute informally, you and IMD Skincare agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms or the Services through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Los Angeles County, California, or by telephone/video where available. The Federal Arbitration Act governs the interpretation and enforcement of this section.
You and IMD Skincare agree that each may bring claims only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Small Claims Court Option: Either party may bring an individual action in small claims court in Los Angeles County, California, if the claim qualifies. 30‑Day Opt‑Out: You may opt out of arbitration by sending a written notice to info@inkedmd.com within 30 days of your first use of the Services after the Effective Date.
19) Termination
We may suspend or terminate your access to the Services at any time for any reason, including if we believe you have violated these Terms or applicable law. Upon termination, the rights and obligations that by their nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution) will survive.
20) Changes to the Services or Terms
We may modify the Services or these Terms at any time. If we make material changes, we will post the updated Terms on this page and update the Effective Date above. Your continued use of the Services after the changes become effective constitutes your acceptance of the updated Terms.
